Maywood Motorcycle Accident Lawyers Jack Kennedy & Daniel Watkins

Our Maywood motorcycle accident lawyers handle the rider cases that turn into long recoveries. Kennedy Watkins Injury Attorneys is two trial attorneys who work every file together, which is the structure you want when a carrier has already decided the crash was your fault.

Riders hurt anywhere on the west side end up at Loyola University Medical Center on First Avenue, which holds a Level I trauma designation and is one of the largest burn centers in the state. If that is where you are reading this, call (312) 448-8181. We answer at any hour, and we will come to your room.

What Happens To A Rider Case In The First Month?

Almost everything that decides the case gets fixed in place during the first month, usually before the rider is out of a wheelchair. That timing is the reason to call early, and it has nothing to do with pressure.

  • Video gets overwritten. Business, warehouse, and apartment cameras along First Avenue and Roosevelt commonly recycle footage within days.
  • The motorcycle gets crushed. Salvage yards work on a schedule, and the damage pattern on the bike is reconstruction evidence.
  • The other vehicle returns to service. Electronic data and commercial maintenance records go with it.
  • The adjuster builds a file. They are recording statements and gathering records, whether or not anyone is doing the same for you.

We send preservation demands the week we are retained and get investigators to the scene while it still looks like it did. None of that requires you to be well enough to participate.

The Crashes We Handle For Maywood Riders

Maywood puts riders on wide arterials that carry freight traffic, then funnels them into Eisenhower ramps and rail crossings. Our work here includes:

The Eisenhower ramps deserve a separate mention. Merge points concentrate speed differentials, and a rider entering or exiting there is dealing with drivers who are changing lanes and checking mirrors rather than looking for a motorcycle.

If your crash does not fit one of those descriptions, call anyway. Unusual facts are common in rider cases, and we would rather look at them than have you assume there is nothing to do.

Catastrophic Rider Injuries And Burn Trauma

A motorcycle crash produces injuries that keep generating costs long after the file at the insurance company goes quiet. That is the part that carriers price wrong, and it is the part we build a case around.

Injuries With A Second Chapter

Orthopedic trauma rarely ends at the first surgery. Hardware gets removed, plates fail, joints above and below a repair wear faster, and a nerve deficit that looked temporary at three months can be permanent at 12.

Burn injuries follow an even longer arc. Grafting, scar management, contracture release, and the psychological weight of visible scarring unfold across years, and no settlement negotiated during the initial hospitalization accounts for any of it.

Putting A Defensible Number On It

We stay in contact with treating physicians about prognosis rather than waiting on a discharge summary, and in serious cases, we bring in reconstruction, vocational, and economic professionals. A permanent limp is only worth what someone can document and explain to a jury.

Fire and burn work is an area where we have taken cases the distance. Our verdicts include a $34 million wrongful death verdict in a case arising from an apartment fire and $7.36 million in a fatal truck crash.

Who Can Be Held Responsible

More parties than people expect, and finding them determines how much coverage is available. A driver who was working at the time brings an employer’s commercial policy into play, and a trucking company can be responsible for its own hiring and maintenance decisions independent of the driver.

Property owners and contractors enter the picture where a hazard or a work zone contributed. Where a road condition is involved, a public entity may share responsibility, which changes both the deadline and the available defenses.

Why Maywood Riders Work With Two Attorneys

Jack Kennedy and Daniel Watkins keep the caseload small so both of them can work each file from the first phone call. For a rider, that means the people evaluating your claim are the people who would try it.

  • Two attorneys on every case. Two sets of eyes on the reconstruction, the medical record, and the settlement math.
  • Someone answers overnight. Crashes do not wait for business hours, and neither do the decisions that follow one.
  • We travel to clients across Illinois. Including hospital rooms, rehabilitation facilities, and first meetings.
  • Trial preparation as the default. Every case is built as though a jury will decide it, which is what moves a carrier’s number.
  • Free consultation, contingency fee. No upfront cost, and no fee unless we recover for you.

Cases in the lower damage range are heard at the Cook County Fourth Municipal District courthouse right here on Maybrook Drive, which handles suburban civil suits of $30,000 or less. Serious rider injuries almost always exceed that and get filed in the Law Division downtown. Call (312) 448-8181 and we will tell you which track applies.

Is A Helmet Required In Illinois?

No. Illinois has no helmet requirement for riders of any age, which means a rider who was not wearing one broke no law and gave the defense nothing to anchor a fault argument to.

Eye protection is the requirement that does exist. Under 625 ILCS 5/11-1404, an operator and every passenger need glasses, goggles, or a transparent shield unless the motorcycle has a windscreen extending above the eyes.

Adjusters raise helmets anyway, especially with a head injury, and they do it informally because there is no violation to cite. Holding on to your gear after a crash is one of the simplest ways to take that argument off the table.

How Does Shared Fault Change What You Recover?

It reduces your recovery by your own percentage, and only bars it if you are found more than half responsible. Under 735 ILCS 5/2-1116, a rider at 50 percent or less still recovers, with damages diminished in proportion to that share. The Illinois Department of Insurance explains the rule for consumers the same way.

Specifically, an insurer that shifts 20 percent onto you has cut its payment by a fifth without disputing a single medical bill. Pushing you past the halfway line eliminates the claim entirely.

That arithmetic is the whole reason the fault questions arrive early, while you are medicated and still learning what is broken. Estimating your own speed on a recorded call is the most common way a strong case gets discounted.

What Are The Filing Deadlines For A Maywood Rider Claim?

Two years from the date of the crash is the general rule under 735 ILCS 5/13-202, and courts treat it as a hard line. A claim brought after a rider dies runs two years from the date of death, which is not always the same date.

Shorter deadlines apply where a public entity may share responsibility. Under the Local Governmental and Governmental Employees Tort Immunity Act, a claim involving the Village of Maywood, a park district, or a transit agency can be limited to one year.

Since a rider often cannot tell at the scene whether a driver or a road condition caused the loss of control, the deadline that applies is not always obvious either. A short call is enough for us to check the dates.

Damages In A Maywood Motorcycle Claim

Illinois allows recovery for financial losses and for the consequences no invoice reflects. A well-documented rider claim generally accounts for:

  • Emergency and surgical care, implanted hardware, and revision procedures
  • Burn treatment, grafting, and scar revision
  • Rehabilitation and anticipated future care
  • Lost wages and earning capacity that does not come back
  • Pain, suffering, and emotional distress
  • Permanent scarring, disfigurement, and loss of a normal life
  • Motorcycle and riding gear replacement

Riders in physical trades often have the largest earning capacity claim and the smallest one on paper. A worker who cannot kneel, climb, or grip for a full shift has lost something real that this month’s pay stub does not show, and proving it usually takes a vocational assessment. Our work injury practice overlaps with rider cases more often than people assume.

Available insurance, rather than the strength of liability, is usually the practical ceiling. Illinois auto minimums do not approach the lifetime cost of a severe burn, so we map every layer, including commercial policies behind a working driver, umbrella policies, and the uninsured or underinsured motorist coverage on your own auto policy.

These are questions Maywood riders and their families raise that the sections above do not cover.
